Terms of Service & Privacy Policy

Terms of Service

These Terms of Service ("Terms") govern your use of the Come Boldly app ("the App"). Come Boldly is made by me, Jonathan Pennington ("I," "me," "my"), an individual developer. By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. The App

Come Boldly is a private, personal prayer app and King James Version Bible reader for Apple devices, offered free of charge. It has no user accounts and stores all of your information on your device. I operate no servers for it, and the App makes no network requests. How your information is handled is described in my Privacy Policy below.

2. License

I grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own personal, non-commercial devotional use on Apple devices you own or control, as permitted by these Terms and by the Apple Media Services Terms and Conditions. You may not sell, rent, sublicense, modify, reverse engineer, or redistribute the App, except where that restriction is prohibited by law or permitted by Apple's terms.

3. Your content and your device

Anything you write in the App (prayer requests, notes, reflections) and any settings, highlights, or bookmarks you create are stored only on your device. You are responsible for your device and for your own backups. I have no access to this information and cannot recover it for you. Deleting the App deletes its data.

4. Tips (in-app purchases)

The App is free and unlocks all of its features without payment. You may choose to leave an optional tip through Apple's in-app purchase system. Tips are voluntary, support the App's development, and unlock no additional features or content. All purchases are processed by Apple; I do not receive your payment details. Tips are generally non-refundable, and refund requests are handled by Apple under its policies.

5. Scripture and content

The King James Version of the Bible is in the public domain in the United States. The App's original text, design, and software are owned by me or my licensors and are protected by applicable law. "Come Boldly" and the Come Boldly logo are my trademarks, and these Terms grant you no rights in them.

6. The focus feature

The App includes an optional feature that can shield apps you choose at prayer times you set, using Apple's Family Controls (Screen Time). It is a personal self-discipline aid, not a security, parental-control, or content-filtering product. The device user can change or turn it off, and it may not block every app or situation. You use it at your own discretion, and I am not responsible for any outcome of using or relying on it, including missed notifications or apps being available or unavailable.

7. Not professional advice

Come Boldly is a personal devotional tool. It does not provide medical, mental-health, legal, financial, or professional counseling advice, and it is not a substitute for a qualified professional or pastor. If you are in crisis or need professional help, please contact a qualified professional or your local emergency services.

8. Acceptable use

You agree to use the App only for lawful, personal purposes, in accordance with these Terms and Apple's terms, and not to interfere with its operation or use it in ways it is not intended to be used.

9. Disclaimer of warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. I do not warrant that the App will be uninterrupted, timely, secure, or error-free, or that it will meet your requirements.

10. Limitation of liability

To the maximum extent permitted by law, I will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of or inability to use the App. To the maximum extent permitted by law, my total liability for any claim relating to the App will not exceed the greater of the amount you paid me, if any, in the twelve months before the claim.

11. Changes

I may update the App or these Terms from time to time. When I change these Terms, I will update the effective date above. Your continued use of the App after changes take effect means you accept the updated Terms. I may also modify or discontinue the App at any time.

12. Apple

These Terms are between you and me only, not with Apple. Apple has no obligation to provide maintenance or support for the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund any purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation for the App. Apple is not responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, and intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-party list.

13. Governing law

These Terms are governed by the laws of Michigan, United States, without regard to its conflict-of-laws rules. Any dispute will be brought in the courts located in Michigan, and you consent to their jurisdiction, except where prohibited by law.

14. General

These Terms, together with the Apple Media Services Terms and Conditions, are the entire agreement between you and me regarding the App, and they replace any earlier understanding on that subject. If any part of these Terms is found to be unenforceable, the rest will remain in effect. If I do not enforce a provision, that is not a waiver of it. You may not transfer your rights under these Terms; I may transfer mine in connection with a sale or transfer of the App.

Privacy Policy

Come Boldly is built to be private. This policy explains what that means.

I do not collect your data

Come Boldly does not collect, transmit, or store any personal data on any server. The App makes no network requests. There are no accounts, no sign-in, no ads, no tracking, and no analytics.

Everything stays on your device

All of your information is stored only on your device, including:

Your app-shielding choices are stored locally through Apple's Family Controls framework in an App Group container on your device. None of this information ever leaves your device, and I have no access to it.

Tips (in-app purchases)

The App is free. If you choose to leave an optional tip, the purchase is handled entirely by Apple. The App receives no payment information or purchase receipts. Apple's handling of your purchase is governed by Apple's own privacy policy.

Children's privacy

The App does not collect any data from anyone, including children.

Your control

Because I collect and hold none of your information, there is nothing for me to access, export, correct, delete, share, or sell on your behalf. Your information lives on your device, under your control. You can remove it at any time by deleting it within the App or by deleting the App.

Changes

If this policy changes, I will update the effective date above.
